Training of Horse

The Trainer shall train horse and perform all services in accordance with generally accepted professional standards. Trainer cannot and does not guarantee the effect of the training program or that any particular results will be achieved, since this depends a great deal on the individual physical and mental ability of each horse.
Trainer will discuss with the Owner the goals of training for each individual horse and keep the Owner updated as to the progress of the horse on a regular schedule.
Training includes the horse being worked 5 days a week and three lessons weekly. Not all lessons will be on your training horse, lessons must be scheduled in advance, normal lesson cancellation policies apply. Lessons will be a mix of group and private at trainers discretion.

Fees and Terms

Owner shall pay the Trainer for professional services
as described below, the fee of $600 per month for a minimum of 30 days. Fees will be billed through National Processing on the Autobilling System. All fees for
training and other incidental services are due on the first of each month, prior to training. Changes in monthly rates
or other charges are subject to alteration upon thirty (30) days notice to Owner. All expenses incurred
for veterinarians, shoeing, or other out-of-pocket cost shall be billed to the owner.

30 days notice is required to remove a horse from training. If horse leaves before this time owner is still responsible for the remainder of the training fees as agreed upon above.
Trainer reserves the right to notify the owner within seven days of the horse’s arrival if horse, in trainer’s opinion, is deemed too unhealthy or too dangerous for the trainer or staff to handle and train. Owner is responsible for recovering horse immediately and for paying all fees incurred.

Veterinarian, Shoeing, and Related Services

Trainer assumes responsibility for arranging
veterinarian and farrier services as necessary. Trainer will use a veterinarian and farrier of his choice to
provide ordinary and necessary care unless Owner has requested Owner's veterinarian and farrier be
used. However, if they are unavailable, Trainer will engage his choice. All veterinarian, farrier, and
medicine expenses shall be paid by Owner, as further described herein. Owner agrees to provide
Trainer with all health records with regard to the horse(s). Owner agrees to have the horse(s) wormed
and vaccinated on a regular schedule. Trainer reserves the right to refuse any horse upon the premises if same does not appear to
Trainer to be in good health, or is deemed dangerous or undesirable.

Risk of Loss and Standard of Care

Owner agrees that the trainer is not liable for death, sickness, and/or accident including consequential damages caused to the horse while in training, except if caused by the willful and wanton negligence of the trainer. In addition, owner agrees to hold trainer completely harmless and not liable for any injury whatsoever caused to the owner, and/or any loss or damage to personal property. It is the responsibility of the owner to carry full liability and mortality insurance coverage for his/her horse, person, and personal property.
Trainer is only responsible for Care, Custody, and Control of horse during training sessions.
